Welcome to Lucky Ladds Terms of Service. Our website is located at www.luckyladds.com.au. By using our services, you agree to comply with these terms and conditions.

  1. Definitions

    • The Agency is Lucky Ladds Pty Ltd.
    • The Client is the individual or company who uses our services.
    • The Performer is an independent contractor who performs at the Client's event and for whom Lucky Ladds Pty Ltd acts as agent.
  2. Services Offered

    Lucky Ladds Pty Ltd ACN 662160643 is a private Australian company with registered offices at 2 Thomson St, Darlinghurst NSW 2010.

    Lucky Ladds Pty Ltd provides booking, coordination, and entertainment supply services for adult-themed parties and private events, and arranging for suitable independent Performers to attend and perform at those events.

  3. Independent Contractors

    Lucky Ladds Pty Ltd contracts with clients in its own capacity for the booking, coordination, administration, and supply of entertainment services. In delivering those services, Lucky Ladds Pty Ltd may engage Performers as independent contractors.

    Performers are not employees, workers, or partners of Lucky Ladds Pty Ltd, and they are not authorised to bind Lucky Ladds Pty Ltd except where expressly authorised in writing. Performers remain responsible for their own taxation, insurance, licences, permits, and compliance with applicable laws. All Performers have their own Australian Business Number.

    Lucky Ladds Pty Ltd is responsible for booking administration, payment collection, scheduling, and client communications. The client must not make separate side arrangements with a Performer that are inconsistent with the booking confirmed by Lucky Ladds Pty Ltd.

  4. Age Requirements

    Our services are only available to individuals who are 18 years or older. All guests and attendees to your event must be over 18 years of age. We reserve the right to check government-issued identification to confirm the age of an attendee.

  5. Payment

    The Client is responsible for paying the full amount of the services provided by our company. Payment must be made in full before the event. We accept payment through bank transfer only.

    • Payment must be paid in full; no partial deposits will be accepted.
    • A booking is confirmed when full payment is received.
    • A travel fee may be incurred and will be included in the price of the service at the time of the booking.
  6. Cancellation, Postponement, and Reschedule Policy

    If the Client cancels the event within seventy-two hours of the event, they will be charged a cancellation fee of 50% of the total amount. If the Client cancels more than seventy-two hours before the event, they will receive a full refund.

    A Client no-show will result in a forfeit of the total amount paid by the Client.

    Performer illness/emergency will result in a full credit or refund of the total amount paid by the Client.

    Events outside either parties’control such as: severe weather, venue closure, road disruption, police action, emergencies will result in a full credit or refund of the total amount paid by the Client.

  7. Substitution and Availability

    Specific Performers are subject to availability. Lucky Ladds Pty Ltd may substitute a comparable Performer if needed. Substitution does not automatically entitle the Client to cancel/refund unless the replacement is materially different and unacceptable.

  8. Scope of Services

    The Performer is contracted as a Performer or Instructor for the agreed upon service. Clients are to behave in a respectful manner at all times during the event, including:

    • No unlawful conduct.
    • No touching unless expressly permitted by the booked service and performer consent.
    • Not take photos or videos without permission.
    • No forced intoxication, harassment, assault, coercion, or unsafe environment.
    • The Performer may stop or leave if boundaries are breached, with no refund.
  9. Client Obligations

    The Client must provide accurate event details, and must provide safe access, parking/loading info, start/end times, venue contact details. The Client is responsible for venue permissions, building rules, council/strata/hotel rules, and security if needed. Delays caused by the Client or venue may shorten the performance without refund.

  10. Direct Dealing / Circumvention

    The Client must not bypass the Agency to book a Performer introduced by the Agency for twelve months since the provision of the Service. If this occurs, the Agency may charge a fee according to our price list at https://www.luckyladds.com.au/pricing and the Service rendered.

  11. Conduct of Performers

    The Performers are professional and well-trained. They are expected to behave in a professional manner at all times during the event. Any inappropriate behavior from the Performer will not be tolerated.

  12. Liability

    Lucky Ladds Pty Ltd contracts with the Client in its own capacity for the booking, coordination, administration, and supply of the Services. In delivering the Services, Lucky Ladds Pty Ltd may engage Performers as independent contractors. To the extent permitted by law, Lucky Ladds Pty Ltd is not liable for any loss, damage, delay, or injury arising from:

    • venue issues, access issues, parking issues, building rules, or venue staff directions;
    • guest misconduct, unlawful conduct, harassment, assault, intoxication, unsafe conditions, or any breach of these Terms by the Client or attendees;
    • inaccurate, incomplete, or late instructions or event details provided by the Client;
    • acts or omissions of third parties outside the reasonable control of Lucky Ladds Pty Ltd; or
    • events outside either parties' reasonable control, except to the extent any refund or credit is expressly provided for elsewhere in these Terms.

    To the extent permitted by law, Lucky Ladds Pty Ltd excludes liability for indirect, consequential, special, or incidental loss, including loss of enjoyment, loss of opportunity, or loss of profits.

    Nothing in these Terms excludes, restricts, or modifies any rights or remedies the Client may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.

  13. Indemnification

    The Client agrees to indemnify and hold harmless our company its employees, agents, and affiliates from any claims, damages, or liabilities arising out of the Client's use of our services that violate these terms, such as unlawful conduct, unsafe venue conditions, or inaccurate Client instructions.

  14. Photos and Videos

    The Performer may take photos and videos during the event with the consent of the Client and attendees of the event. By using our services and consenting to the recording of photos and/or videos, the Client agrees to allow our company to use these photos and videos for promotional purposes.

  15. Intellectual Property

    The Agency has ownership of website content, branding, photos and copy. No scraping or reuse is allowed without permission. No misuse of the website is allowed.

  16. Privacy

    The Client and attendees of the event must seek consent from the Performer to photograph/record performances. Promotional use of materials recorded by the Client or other attendees at the event is not permitted.

  17. Amendments

    Our company may make changes to these terms and conditions at any time. The Client will be notified of any changes, and the updated terms and conditions will be posted on our website.

  18. Termination

    Our company may terminate these terms and conditions at any time without notice. The Client will be notified of any termination, and the terms and conditions will be posted on our website.

  19. Entire Agreement

    These terms and conditions constitute the entire agreement between the Client and our company, and supersede all prior agreements.

  20. Disclaimer

    By booking, you acknowledge:

    • You are over 18 years of age.
    • You understand that our Performers are independent contractors providing adult-themed entertainment.
    • You will provide a private, safe, and respectful space for the performance.
    • You understand that Performer substitutions may occur when required.
    • You acknowledge our cancellation and refund policy.
    • You understand the nature of the entertainment booked and accept full responsibility for ensuring compliance with local laws and property rules.
    • You agree not to solicit or attempt to negotiate for additional services directly with the Performer without contacting LuckyLadds.
  21. Complaints and Dispute Resolution

    Complaints must first be raised in writing to LuckyLadds via the email address [email protected] within twenty-four hours of the completion of the Service. Complaint resolution must be attempted with communication with Lucky Ladds Pty Ltd prior to governing law/jurisdicition.

  22. Governing Law

    These terms and conditions shall be governed by and construed in accordance with the laws of the state of New South Wales and its courts. By using our services, you agree to comply with these terms and conditions.

  23. Australian Consumer Law

    Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law. Where the law permits us to do so, and where the services are not ordinarily acquired for personal, domestic or household use or consumption, our liability for a failure to comply with a consumer guarantee is limited to either: (a) supplying the services again; or (b) paying the cost of having the services supplied again.
